The objective of this interactive course is to introduce aspiring lawyers to the general law and practice of commercial and investment arbitration. We will focus on arbitration's regulatory regimes, the fundamental nature of the The objective of this interactive course is to introduce aspiring lawyers to the general law and practice of commercial and investment arbitration. We will focus on arbitration's regulatory regimes, the fundamental nature of the arbitration agreement in any consensual arbitration; the role of the arbitrators in the reference; and how the final award can be enforced or challenged before a national court. We will consider ad hoc and institutional arbitrations. The course will be taught through a critical engagement with relevant laws, rules, decisions from national courts, and legal writings on the subject. At the end of the course, students should be very familiar with current academic discourses on these topics in addition to having a very good understanding of how arbitration functions in practice. Students will have the opportunity to work on a case study throughout the course. The case study is to be determined. Students will have to read and comment various documents in class including cases, articles and Rules.
